In an action to recover damages for personal injuries, etc., the plaintiffs appeal from so much of an order of the Supreme Court, *825Suffolk County (Berler, J.), dated February 26, 2004, as granted the defendant’s motion for summary judgment dismissing the complaint and denied, as academic, that branch of their cross motion which was for leave to amend their bill of particulars.

Ordered that the order is reversed insofar as appealed from, on the law, with costs, the motion is denied, the complaint is reinstated, that branch of the cross motion which was for leave to amend the bill of particulars…
