— On September 28, 1911, the grand jury of Frio County, indicted the appellant in three counts — first, for an assault with intent to rape Annie Lee Burgin; the second, for an attempt to have carnal intercourse with her without her consent, said attempt not constituting an assault with intent to commit rape; and third, with burglary at night of the house of T.
