The litigation involving the validity and scope of the Cutcheon patent has been protracted over a period of eight years. Questions in respect to its validity and scope, in different aspects, have been several times before the circuit court', and twice before the circuit court of appeals for the First circuit, wherein its patentability and its utility have been repeatedly sustained and explained.
