Appeal by the Comptroller of the City of New York and another, from an order of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the 21st day of January, 1921, directing the comptroller of the city of New York on behalf of the city of New York to pay to the respondent interest on a certain award from the date of the commissioners’ report to the date of the confirmation thereof.

Dowling, J.:
The commissioners of estimate and assessment in the Seventh avenue proceeding were appointed July 31, 1913. Title to the property acquired therein vested in the city of New York September 3, 1913. The commissioners’ final report was dated July 24, 1919, and was confirmed by an order of the Supreme Court entered November 19, 1919. By that report the commissioners made an award for parcel damage No. 26 (the property involved in this controversy) to unknown owners in the sum of $31,731.20 and $11,216.98 interest, making a total of $42,948.18.
