The defendant, having accepted the suggestion of the court at the close of the plaintiff’s case and reserving its motion to dismiss at that time, now at the close of the entire case moves first to dismiss the complaint with the same force and effect as if made at the close of the plaintiff’s case, and at the close of the entire case moves to dismiss the complaint and/or for the direction of a verdict in favor of defendant.
