The appellee sues as a taxpayer and citizen of the city of Richmond, and asks that the city officers he enjoined from erecting buildings on land which it claims to have acquired by a lease. The theory upon which the complaint proceeds is, that the city can acquire no rights in the land on which its officers propose to erect the buildings.
