PRICE, Chief Justice.

This is an appeal from a judgment of the District Court of Nueces County, 117th Judicial District. The Reconstruction Finance Corporation, hereinafter referred to as “Appellee” sued Jno. Q. McAdams as Banking Commissioner and as statutory receiver of The Texas State Bank & Trust Company of Corpus Christi, Texas; the Attorney General, the State Treasurer, as composing the State Banking Board, and the State Banking Board, seeking to subject its claims to certain funds held on deposit in the State Bank by the State Banking Commissioner.
