This is an appeal under the Post-Conviction Hearing Act (Ill. Rev. Stat. 1973, ch. 38, par. 122 — 1). The defendant was convicted of attempted murder on May 20, 1971, and sentenced to a term of not less than 10 nor more than 15 years in the penitentiary. In October, 1971, the defendant filed a petition for rehearing on aggravation and mitigation. This court treated the petition as one for post-conviction relief and remanded the case to the circuit court of Winnebago County for an evidentiary hearing under the Post-Conviction…
