As this was an executory sale of a house and one acre of ground by appellee to appellant, Lucy, at the 'price of $2300, of which $1000 was paid at the time, and the residue to be paid March 1, 1868, when the deed was to be made as evidenced by a memorandum signed by Baxter, Mrs. Harcourt and her husband, dated January 11, 1868, and much of the deferred payment being paid.
