Edward Hoye, trustee under the will of John Hoye, in *337whose place the appellant was substituted, instituted an. ejectment suit in the Circuit Court for Garrett County, to recover from the appellee possession of a tract of land known as “ Lot No 858 ” of the military lots west of Fort Cumberland.
