*639In an action, inter alia, to recover damages for personal injuries, the defendants Sung S. Han and Kim Chong Gak appeal, as limited by their brief, from so much of an order of the Supreme Court, Queens County (Dollard, J.), dated May 18, 2004, as denied that branch of their cross motion which was for summary judgment dismissing the complaint and all cross claims insofar as asserted against them.
