— The defendant, Jack Johnson, was on March 2, 1910, convicted in the circuit court of Bibb county of the offense of murder in the first degree, and, as punishment for such crime, was by said court sentenced to be hanged. He appealed from that judgment to this court; but this court affirmed the judgment of the Bibb county circuit court. • Thereupon, on the 12th day of February, 1911, the Governor of Alabama, to whom an appeal was made for executive clemency, commuted the defendant’s sentence to life imprisonment. .
