MEMORANDUM OPINION

DONALD J. PORTER, District Judge.

Petitioner Dennis Ray Lufkins was convicted of voluntary manslaughter on July 1, 1980, in the Fifth Judicial Circuit Court of South Dakota. He is currently serving a term of life imprisonment in the South Dakota State Penitentiary. He has applied to this Court for a writ of habeas corpus as provided by 28 U.S.C. § 2254 and § 2241(c)(3).
