CHRISTIAN, Judge.
The offense is murder; the punishment, confinement in the penitentiary for fifty years.
It was charged in the indictment, in substance, that appellant, with malice aforethought, killed J. C. White by shooting him with a gun.
Appellant was employed by the State Highway .Department and was engaged in working on the highways in Terry county. He and his family lived in the town of Brownfield, they having moved to Terry county something over two years prior to the homicide.
