This is a suit in assumpsit commenced by appellant in the superior court of Cook county to recover damages suffered by him by reason of the alleged wrongful forfeiture by appellee of a contract entered into by the said parties, by which appellant undertook to excavate a section of the drainage canal extending from Willow Springs south-west six thousand feet.
