KING, Judge.

The sole issue presented by this appeal is whether the trial court was correct in granting plaintiff a hardship-restricted drivers license.

Roger C. Dixon (hereinafter plaintiff) was found asleep in his ear by a law enforcement officer who detected the presence of alcohol on his breath. The officer administered a field sobriety test, which plaintiff failed, and plaintiff refused to take a chemical test for intoxication.
