The plaintiff in error was convicted in the circuit court of DeKalb county of the charge of assault with intent to commit rape. An indictment consisting of eleven counts was filed against him, the first seven of which charged the taking of indecent liberties with Mary Charmois. Two (the eighth and ninth) charged assault with intent to commit rape on Mary Charmois, a female child under the age of sixteen years, to-wit, of the age of thirteen years. .
