SABERS, Justice.

[¶ 1.] Lennis Rennieh-Craig (Rennich) motioned for summary judgment that the trial court failed to hold a mental health hearing pursuant to SDCL 23A-7-16. The habeas court denied the motion and quashed the writ of habeas corpus. Ren-nich appeals. We reverse and remand.

FACTS

[¶ 2.] Renpich, born October 22, 1950, was charged with six forgeries and 20 burglaries in June of 1996. These crimes were committed between May 28 and June 10, 1996. On July 23, 1996, she appeared at her arraignment, waived the preliminary hearing and, pursuant to a plea agreement, entered a plea of guilty…
