This was a suit in trespass to try title in the district court of Leon county, Tex., by Mrs.. Eliza Kempner against Gilbert Gresham and the heirs of Leroy Boulware. A trial before the court without a jury resulted in a judgment for the plaintiff. The defendants, the Boulware heirs, have appealed.

The land in question was patented to Leroy Boulware. The appellants are his heirs. The appellee established title to the land from the heirs of A. H. Wier and sought to establish by circumstances the existence of a deed from the heirs of Leroy Boulware by their attorney in fact to A. H. Wier. The…
