A general demurrer to the complaint of the Colorado Investment and Realty Company was sustained, the plaintiff stood upon its complaint, and the case was dismissed.

From the allegations of the complaint, some of which were stricken out on motion, it appears that one Cross owned a quarter-section of land in the Riverview drainage district, which was organized in 1921; that the plaintiff then held a trust deed of the land; that the drainage ditch as planned traversed the land in question, and, if constructed as planned, would benefit the land; that the land was assessed for benefits upon the…
