This is an action for partition. The amended complaint alleges: that plaintiff and defendant were married on December 13, 1937; that they acquired title to the real estate in question by deed dated June 24, 1944, in which ‘ ‘ Frederick 0. Hosford and Isabel Hosford, his wife” (plaintiff and defendant herein) were named as grantees; that on the 27th day of June, 1944, plaintiff and defendant executed and delivered to the mortgagee a mortgage upon said premises; that on the 10th day of March, 1947, an interlocutory decree of divorce was granted in favor of the plaintiff husband and that said…
