—Appeal from a judgment of the Supreme Court (McGill, J.), entered May 29, 1998 in Clinton County, which, in a proceeding pursuant to CPLR article 78, dismissed the petition as duplicative.

Petitioner, a prison inmate, commenced this proceeding by order to show cause dated December 17, 1997 to challenge a disciplinary determination, contending that he was improperly denied a prehearing assistant and that the regulation denying such assistance was unconstitutional.
