There are before us for review the dismissal of an appeal from a justice of the peace to the county court, and the refusal of the county court to dismiss the action itself.

Flalce, defendant in error, recovered a money judgment before the justice of the peace against the Poudre River Corporation, plaintiff in error, which duly perfected an appeal to the county court. The judgment of the justice of the peace was thus superseded, and the case stood in the county court for trial de novo. McCreary v. Brady, 26 Colo. App. 297, 143 Pac. 829; Smith v.
