This is a bill in equity for specific performance of a written contract whereby, it is alleged, the defendants agreed to indemnify the plaintiff for certain succession taxes levied upon him and paid by him to the Commonwealth. The defendant James E. O’Donnell was not served with process, and did not appear or answer. The defendant Butler in her answer denies that the tax fell within the terms of the agreement. The case was heard by a judge, who filed “findings, rulings and order for decree.” A final decree was entered dismissing the bill, and the *505plaintiff appealed. The evidence is reported.…
