GENOVESE, Judge.

| defendant, Christopher Henry Joseph, appeals his first degree murder conviction and life sentence, alleging insufficiency of the evidence and excessive sentence. We vacate Defendant’s conviction and sentence for first degree murder, render a judg*924ment of conviction on the lessor included responsive offense of second degree murder, and remand the case to the trial court for resentencing.
