This action was brought in the name of the People of the State of Illinois, for the use of Frederick Tilton, against the Chicago and Eastern Illinois Railroad Company, to recover a penalty imposed by the act of 1877, amendatory of section 62, of chapter 114, of the Revised Statutes of 1874. On the trial in the circuit court, plaintiff recovered a judgment for $100, which was affirmed in the Appellate Court for the Third District, and defendant brings the ease to this court on error.
