This action has been brought by the plaintiffs to recover for damages to their residence property resulting -from the fall of a limb of .a large tree located along the *295street in the defendant village upon which plaintiffs’ property abutted. The action was placed on the trial calendar in Oswego County and upon being reached for trial, it was agreed in open court that the action be tried before the court without a jury.
