Error to Circuit Court, Kanawha County. Action by the City of Charleston, on the relation of Elijah Peck, against Howard Dawson and Mose Pushkin. Judgment for defendants on a directed verdict, and plaintiff brings error.

Ritz, Judge:

In this action, brought for the purpose of recovering damages for the death of Edwin Peck, resulting from the alleged negligent discharge of a pistol in the hands of the defendant Dawson, a judgment Avas rendered upon a directed verdict in favor of the defendant, to review which this writ of error is prosecuted.

The defendant Dawson was a police lieutenant of the city of Charleston. On the evening of the 20th of May, 1917, upon a complaint made before the police judge of said city; a warrant was issued for the arrest of Edwin Peck upon a charge of unlawfully and feloniously…
