SHIPMAN, Circuit Judge.

The facts in the case are undisputed. Wood & Payson exported from Russia 513 bales of Donskoi wool, of the third class, upon which the proper rate of duty under the tariff act of October 1, 1890, was 32 per cent, ad valorem. The other facts are succinctly stated by the board of general appraisers as follows:
