McCALEB, Justice.

Michael Cannella, as mortgage creditor of his deceased father, Vincenzo Cannella, brought executory proceedings and secured a writ of seizure of the mortgaged property bearing Municipal Nos. 2411-2413 Royal Street in the city of New Orleans.
