Appeal from a judgment of the superior court for Spokane county, Hum, J., entered February 27, 1918, upon the verdict of a jury rendered in favor of the plaintiff, in an action in tort.

The respondent Cora Allen, while alighting from a street car on one of the streets of the city of Spokane, was struck and injured by an automobile owned by the appellant Christ Schultz and *394driven by the appellant Jake Schultz. She brought this action to recover for the injuries received, averring in her complaint that the accident was the result of negligence on the part of the driver of the automobile.
