INTRODUCTION

Ricky L. Cox appeals the denial of his motion for discharge based upon the State’s alleged failure to provide him with a speedy trial in violation of his statutory and constitutional rights. For the reasons set forth, we reverse, and remand with directions to dismiss.

STATEMENT OF FACTS

On August 4, 1999, a complaint was filed in Adams County Court charging Cox with two counts of first degree sexual assault, in violation of Neb. Rev. Stat. § 28-319(l)(c) (Reissue 1995). On September 9, a hearing was held in the county court, at which time Cox waived a preliminary hearing and was…
