On November 13, 1986, we issued a stay requested by the State of Ohio. The purpose of this opinion, issued after the entry of that order, is to clarify the standards we will apply in reviewing an application for a stay of a proceeding or for a stay directing affirmative action on the party of a federal agency. This stay was requested pursuant to Rule 18 of the Federal Rules of Appellate Procedure, 5 U.S.C. § 705, and 28 U.S.C. § 2349(b).
