In the motion for a rehearing in this case it is alleged that this court overlooked the eases of Dougherty v. Bethune, 7 Ga. 90, and Mitchell v. Lasseter, 114 Ga. 275 (40 S. E. 287). We did not overlook these eases, but we did not specifically deal with them, being of the opinion that the ruling made sufficiently answered the contention that the decisions in those cases were controlling in the present case.
