On the 23d day of November, 1894, the parties to this action entered into a contract of sale in and by which the defendant agreed to sell and plaintiffs to purchase certain real estate situate in the city of New York for the sum of $24,000, and the plaintiffs then paid, to apply on the purchase price, the sum of $500.
