On June 15, 1931, plaintiffs, J. W. Payne, J. M. Bull, J. M. Grigsby, J. C. May, F. Dodson, Sr., O. C. Rifenberg, Calvin Flowers, K. K. Thomas, and J. D. Donley, presented to the Honorable E. J. Pickens, district judge of Ochiltree county, Tex., in chambers, their petition seeking a temporary injunction restraining the city of Perryton, its mayor and aldermen, from reassessing against the plaintiffs and their property two-thirds of the cost of paving certain streets in the corporate limits of the city, fronting the respective properties of the plaintiffs, and from issuing paving certificates…
