T. E. Johnson was convicted in the circuit court of Lafayette county of passing a worthless check; the in dictment being drawn under chapter 172, Laws 1924, sections 924 and 925, Code 1930. On appeal to this court, the constitutionality of the said chapter 172-, Laws of 1924, was challenged, but the court expressly declined to pass upon that question. The judgment of the court below was reversed, 159 Miss. 703, 132 So. 330, on account of the failure to give the accused written notice of the nonpayment of the check, as required by section 924, Code 1930.
