TORRUELLA, Circuit Judge.
This appeal arises from an order of the Rhode Island District Court dismissing plaintiff New England Data Services, Inc.’s complaint. The complaint alleged a violation of the Racketeer Influenced and Corrupt Organizations Act, 18 U.S.C. § 1961 et seq., (“RICO”), and three state law claims. The district court dismissed the RICO claim for failure to plead the predicate acts of mail and wire fraud with sufficient particularity pursuant to Fed.R.Civ.P. 9(b).
