The defendant has moved by omnibus motion, dated December 16, 1997, for various forms of pretrial relief. The motion is decided as follows:

A. Constitutionality of the Statute

The defendant alleges that the statute under which he is charged is void for vagueness because there is no standard articulated from which it can be determined what conduct is “clearly inherent in the nature of an office” and, therefore, his due process rights have been violated.
