BROCK, Justice.
The plaintiff, Barbara Lynn Davis, seeks a permit for the sale of beer for off-the-premises consumption at her Pantry Food Store at Louisville in Blount County, Tennessee. The Blount County Beer Board denied her application solely upon the ground that Fred Reagan, the owner of a residential dwelling house located within 300 feet of the plaintiff’s store, objected to issuance of the permit.
