INTRODUCTION

The plaintiff, Michael Fisher (“Fisher”) filed a lawsuit against Memorial Health Care2 (“Memorial”), Worcester State University3 (“WSU”), and Pedro Toro (“Toro”), alleging battery, intentional infliction of emotional distress, negligence and negligent infliction of emotional distress.
