Plaintiff, the School District of Radnor Township, commenced the instant action in assumpsit against defendant, Valley Forge Military Academy Foundation, seeking the recovery of a payment in the approximate amount of $49,400 pursuant to the provisions of a written agreement between the parties executed on May 14, 1945. Plaintiff characterizes the payment sought as one “in lieu of taxes”; defendant, on the other hand, contends that the payment sought, in fact, represents real estate taxes.
