HENLEY, Chief Judge.

This is an action to establish plaintiff’s claimed ownership of the oil, gas, and petroleum distillate underlying a 40-acre tract of land in Pope County, Arkansas, to cancel an oil and gas lease covering said lands and executed by defendant Missouri Pacific Railroad Company (hereinafter Railroad) to the defendant Gulf Oil Corporation (hereinafter Gulf), and to cancel a certain “Declaration of Pooling” affecting the oil and gas underlying said lands.
