This is an action arising under the federal Racketeer Influenced and Corrupt Organization Act (“RICO”); the complaint also asserts state law fraud and negligent misrepresentation claims. The claims are based on the defendants’ (hereinafter “Home Depot”) 1 tool rental service offered at some Home Depot home improvement retail stores. The plaintiff alleges that Home Depot has engaged in a fraudulent scheme over the past ten years to induce tool rental customers into purchasing allegedly unnecessary damage protection.
