MB. JUSTICE ANGSTMAN:

Defendant is an unincorporated fraternal benefit society organized under the laws of the state of Ohio and operating on the Lodge System with a membership composed of locomotive firemen and enginemen. It engages in business in Montana, a part of which consists of issuing life insurance certificates to its members. In March 1942 Baymond W. Spalding, a locomotive fireman, became a member of Lodge No. 191 at Livingston and was issued such a policy of insurance in the sum of $2,000. He was then the husband of plaintiff.
