The defendant was convicted in the District Court on three counts of violating 18 U.S.C. § 1361. 1 The indictments charged him with causing others to enter and trespass upon Government-owned real property, that is, vacant houses owned by the Department of Housing and Urban Development (HUD).

During 1973-74, HUD was repairing and selling in Detroit some houses which it had acquired from lending institutions pursuant to its Federal Housing Administration mortgage insurance program following default and foreclosure.
