A. L. See, a locomotive engineer in the employ of plaintiffs in error, as receivers of the Kansas City, Mexico & Orient Railway Company of Texas, was run over and injured by a backing engine in the yards of said company at San Angelo on the 10th of August, 1913, as a result of which he thereafter died, and this suit was brought against said company and S. B. Hovey and M. L. Mertz, as receivers, by Mrs. Dora Scott See, surviving widow, in behalf of herself and Mrs. K. A. See, mother of deceased, to recover damages therefor. Pending the litigation the receivers were discharged, and the suit was…
