Appellant is in jail on a charge of armed robbery. Section 2367, Code 1942. He was denied bail on a habeas corpus petition, which was dismissed.
*376This appeal presents four assignments of error relevant to the dismissal of appellant’s petition. They may be consolidated into two complaints. First, the trial judge erred in failing to discharge appellant; Second, the trial judge erred in failing to enlarge appellant on bail. We overrule the first.
The facts in the record reveal that on the evening of April 7, 1950, in the City of Hattiesburg, a citizen thereof drove to his home about seven o’clock.…
