Joe Moore has petitioned this court for a writ of habeas corpus. It appears from the petition that he is incarcerated in the State Penitentiary in Burleigh county, and that the district court of that county has denied an application for habeas corpus. The petition recites that the petitioner is illegally restrained of his liberty and confined in the state penitentiary by virtue of a judgment rendered by the district court of Stark county on July 25th, 1941, and that said judgment is null and void and of no force and effect.
