OPINION
By THE COURT:(1) This case originated in the Municipal Court of Cincinnati, from which it was appealed to the Court of Common Pleas of Hamilton County, Ohio. While it was pending in that court it was discovered that through inadvertence the bill of exceptions had been filed and stamped in the Court of Appeals, and given the number of a prior appeal of this case to this court. Upon discovery of the error, the defendant-appellant moved the Common Pleas Court for an order for leave to file the bill of exceptions in this case in the Common Pleas Court.
